{"id":24466,"date":"2017-12-28T18:18:18","date_gmt":"2026-03-11T22:33:35","guid":{"rendered":""},"modified":"2026-03-11T23:33:35","modified_gmt":"2026-03-11T22:33:35","slug":"whistleblower-protection-january-2018","status":"publish","type":"post","link":"https:\/\/www.boostrh.com\/en\/whistleblower-protection-january-2018\/","title":{"rendered":"Creation of Whistleblower Protection as of January 1, 2018"},"content":{"rendered":"<h2><span style=\"color: #00aae8\">The Whistleblower<\/span><\/h2>\n<p>Companies with at least 50 employees must, from January 1, 2018, establish a whistleblower mechanism.<\/p>\n<p>A <strong>whistleblower<\/strong> is a person who discloses or reports, in a disinterested manner and in good faith, a crime, an offense, or a serious and manifest violation of the law, of which they have personal knowledge.<\/p>\n<p>Accordingly, employers must implement, by January 1, 2018, a <strong>procedure for collecting reports<\/strong> that sets out the conditions under which the whistleblower:<br \/>\n&#8211; addresses their report to their direct or indirect line manager, to the employer, or to the designated contact person appointed by the company;<br \/>\n&#8211; provides the relevant facts, information, or documents, regardless of their form or medium;<br \/>\n&#8211; provides the elements enabling, where applicable, an exchange with the recipient of the report.<\/p>\n<p>It should be noted that the <strong>whistleblower contact person designated by the employer<\/strong> may be internal or external to the company. They may be a natural person or a public or private law entity.
